法定节假日加班工资,三倍还是四倍?

roman'">《劳动法》第四十四条第三项规定,法定休假日安排劳动者工作的,用人单位应当支付不低于工资的百分之三百的工资报酬。对此,在实践中有二种观点,一种观点认为,法定节假日加班的,用人单位应当支付不低于百分之三百的工资报酬,这里的“工资报酬”中已经包括了正常的一倍工资,用人单位在之外只需要另行支付给劳动者百分之两百的加班工资,加起来法定节假日可以获得三倍工资,这种观点也可以简称为“三倍工资说”;第二种观点与第一种观点完全相反,这种观点认为,这里的“工资报酬”不包括正常情况下的一倍工资,用人单位在正常一倍工资之外应该另行支付百分之三百的加班工资,加起来法定节假日可以获得四倍工资,这种观点可以简称为“四倍工资说</span><span style="font-size:10pt">[1995]226</span><span style="font-size:10pt;font-family:宋体;mso-ascii-font-family:'times new roman';mso-hansi-font-family:'times new roman'">号)第一条又规定,“安排在法定休假节日工作的,应另外支付给劳动者不低于劳动合同规定的劳动者本人小时或日工资标准</span><span lang="EN-US" style="font-size:10pt">300</span><span style="font-size:10pt;font-family:宋体;mso-ascii-font-family:'times new roman';mso-hansi-font-family:'times new roman'">%的工资。”由于法定节假日是计薪的,所以另行支付三倍加班工资后,劳动者在法定节假日加班可以获得所谓四倍工资。</span><span lang="EN-US" style="font-size:10pt"><p></p></span></p><p class="MsoNormal" style="font-size:10pt;font-family:宋体;mso-ascii-font-family:'times new roman';mso-hansi-font-family:'times new roman'">号文,已废止</span><span lang="EN-US" style="font-size:10pt">)</span><span style="font-size:10pt;font-family:宋体;mso-ascii-font-family:'times new roman';mso-hansi-font-family:'times new roman'">规定:职工全年月平均工作天数和工作时间分别调整为</span><span lang="EN-US" style="font-size:10pt">20.92</span><span style="font-size:10pt;font-family:宋体;mso-ascii-font-family:'times new roman';mso-hansi-font-family:'times new roman'">天和</span><span lang="EN-US" style="font-size:10pt">167.4</span><span style="font-size:10pt;font-family:宋体;mso-ascii-font-family:'times new roman';mso-hansi-font-family:'times new roman'">小时,这里剔除了国家规定的</span><span lang="EN-US" roman'">天法定节假日,法定节假日被折算成不计薪了,这显然有违《劳动法》。为纠正、解决这个问题,劳动部</span><span lang="EN-US" style="font-size:10pt">2008</span><span style="font-size:10pt;font-family:宋体;mso-ascii-font-family:'times new roman';mso-hansi-font-family:'times new roman'">年又出台了《关于职工全年月平均工作时间和工资折算问题的通知》(劳社部发</span><span lang="EN-US" style="font-size:10pt">[2008]3</span><span style="font-size:10pt;font-family:宋体;mso-ascii-font-family:'times new roman';mso-hansi-font-family:'times new roman'">号),该《通知》指出,按照《劳动法》第五十一条的规定,法定节假日用人单位应当依法支付工资,即折算日工资、小时工资时不剔除国家规定的</span><span lang="EN-US" style="font-size:10pt">11</span><span style="font-size:10pt;font-family:宋体;mso-ascii-font-family:'times new roman';mso-hansi-font-family:'times new roman'">天法定节假日。据此,日工资、小时工资的折算为:日工资:月工资收入÷月计薪天数。这里,不同于以前,首次出现了一个“月计薪天数”的概念,月计薪天数=(</span><span lang="EN-US" style="font-size:10pt">365</span><span
